Assisted Living Basics

Read this before you sign an Arizona assisted-living residency agreement

The residency agreement is where an assisted-living facility’s promises, fees, responsibilities, and exit rules become concrete. Ask for it before move-in day and compare it with the service plan.

The tour may show you the dining room, activities and available apartment. The residency agreement tells you what the assisted-living facility is actually promising to provide and what the resident is agreeing to pay and do.

That makes the agreement one of the most important documents a family will review. It should not be saved for the final minutes before move-in, when boxes are packed and everyone feels pressure to finish the admission.

Arizona’s assisted-living rules require a manager to ensure that a documented residency agreement is in place before or at the time a person is accepted. The Arizona Department of Health Services’ assisted-living checklist identifies several items that should appear in that agreement: the resident’s name, the terms of occupancy, resident and facility responsibilities, included services, services available for an added charge, refund rules, termination policies and the complaint process.

Those headings are useful, but the details underneath them are what determine whether a family understands the arrangement.

Start with the services included in the quoted price

Ask the facility to point to the section that lists the services included in the monthly rate. Then compare that language with what you heard during the tour.

Does the rate include help with bathing, dressing, toileting or transfers? What about medication reminders, assistance with self-administration or medication administration? Are transportation, escorts to medical appointments, incontinence supplies, laundry or special diets included?

Avoid relying on broad phrases such as “personal care included.” Ask for the amount, type and frequency of assistance to be clear. The resident’s service plan is the document that should describe the resident’s needs and the specific assisted-living services the facility will provide. The agreement and service plan should make sense together.

Identify every charge that can change

Arizona’s checklist specifically calls for a list of services available for an additional fee or charge. Ask for the current fee schedule and whether the facility can change those charges during the residency.

Useful questions include:

  • What triggers a higher level-of-care fee?
  • Who determines that the resident’s care level has changed?
  • How much notice will the resident or representative receive?
  • Are there separate charges for two-person assistance, nighttime checks, medication services, transportation or supplies?
  • Is there an annual increase, and is it capped?

If a fee is important to your decision, ask for the answer in writing. A verbal estimate is difficult to rely on later.

Read the nighttime staffing language

For an assisted-living home, the agreement should say whether the manager or a caregiver is awake during nighttime hours. “Staff on site” and “awake staff” are not the same thing.

Ask how a resident calls for help overnight, what happens if the only caregiver is assisting someone else and how staffing changes when several residents need more care. Match the answer to your family member’s actual needs, especially if the person wanders, needs frequent toileting help or may need an urgent response.

Understand refunds and both termination policies

Families often focus on the move-in date and skim the sections explaining how the arrangement ends. Read them closely.

The agreement should include the facility’s policy for refunding fees, charges or deposits. It should also describe how a resident may terminate the residency, including when agreed services are not being provided according to the service plan. Separately, it should explain how the facility may terminate the residency.

Ask for specific notice periods and examples. What happens if the resident is hospitalized? Can the room be held, and at what cost? What happens to prepaid fees after death or a permanent transfer? What conditions could lead the facility to say it can no longer meet the resident’s needs?

Arizona law now also requires an assisted-living facility to include a statement of the resident’s rights in a discharge or eviction notice. That protection matters if a termination occurs, but families should still understand the facility’s policy before admission.

Find the complaint process before you need it

The required agreement content includes the complaint process. Look for whom to contact inside the facility, how to submit a concern in writing and how the facility documents its response.

An internal complaint process does not prevent a family from contacting the appropriate government agency. Still, knowing the facility’s escalation path can help resolve a service or billing problem early and create a written record.

Take the agreement home

Ask for a blank or proposed agreement during the comparison stage. Read it away from the tour. Mark unclear language and return with questions. If the contract involves substantial entrance fees, unusual financial terms, arbitration language or questions about a resident’s legal authority to sign, consider having an Arizona attorney review it.

The goal is to make sure the facility, the resident and the family begin with the same expectations.

Pip's Tip

Ask for the residency agreement before move-in day, then compare its promises and charges with the resident’s service plan.

Questions to Ask

  • Which services are included in the monthly rate, and which cost extra?
  • What triggers a higher level-of-care fee, and how much notice will we receive?
  • Is a manager or caregiver awake overnight?
  • What are the refund, resident-termination, facility-termination, and complaint procedures?
